Terms of Use

The agreement between you and us when you use Embering. We've kept it in plain language, because terms nobody can read protect nobody.

The short version

1. Agreement

By downloading or using Embering, you agree to these terms. If you don't agree, please don't use the app. These terms are between you and Embering LLC, a Wyoming limited liability company with its registered office at 30 N Gould St Ste N, Sheridan, WY 82801, USA ("we", "us"). They are not an agreement with Apple or with Google.

2. Your licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to use Embering on devices you own or control, in line with the terms of the store you installed it from (Apple's App Store Terms of Service, or Google Play's Terms of Service). You may not copy, resell, sublicense, reverse-engineer, or redistribute the app or the writing served through it.

3. The writing in the app

Quotations, readings and linked works remain the property of their authors and rights holders. Your licence to use Embering does not give you any right to republish that material elsewhere.

Anything you write in the app — your own affirmations, your recall attempts, your reflections — remains yours. We claim no ownership of it. As described in the Privacy Policy, most of it never leaves your device at all.

4. What it costs

The daily quotation is free, and always will be. No account, no payment, nothing to cancel.

Founding Reader. Everyone who installs Embering before we close it keeps the full practice — the Memory Coach, your own lines in the rotation, every widget style — free for life. Claiming it is a purchase at no cost, made through the App Store or Google Play so it can be restored if you change phones. It costs nothing now and will never start costing anything.

Plus. For readers who join later, the same practice layer is an optional subscription. The current price and billing period are shown in the app and in the App Store or Google Play before you buy — we don’t repeat them here, because prices differ by country and change over time, and a figure on this page would eventually be wrong.

If a free trial is ever offered, any unused portion is forfeited when you buy a subscription.

5. Using it well

Please don't use Embering to break the law, to infringe anyone's rights, or to try to disrupt or gain unauthorised access to the service. We may suspend access if you do.

6. Embering is not therapy

Embering supports reflection, memorisation and attention. It is not medical care, mental-health treatment, crisis support, or professional advice of any kind, and it should not be used as a substitute for them. If you are struggling, please contact a qualified professional or a local crisis service.

7. Availability and changes

We may change, suspend or discontinue parts of Embering. We'll try to give reasonable notice of significant changes. Some features depend on services outside our control, including Apple's, Google's, and your network.

8. No warranty

Embering is provided "as is" and "as available", without warranties of any kind to the fullest extent the law allows. We don't warrant that it will be uninterrupted, error-free, or that reminders will always be delivered — device settings, permissions and operating-system behaviour all affect that.

9. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental or consequential losses arising from your use of Embering. Where liability cannot be excluded, it is limited to the amount you paid us in the twelve months before the claim.

10. The app stores

Embering is distributed through Apple's App Store and Google Play. Whichever you installed from, that store is not a party to these terms, has no obligation to provide support for Embering, and is not responsible for the app or its content. Support questions come to us, at admin@embering.app.

Apple. If you installed from the App Store: Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Any claim that the app fails to conform to a warranty may be reported to Apple, which may refund the purchase price; beyond that, Apple has no warranty obligation. Your use must also comply with the Apple Media Services Terms and Conditions.

Google. If you installed from Google Play: your use is also subject to the Google Play Terms of Service, and refunds and billing disputes for purchases made there are handled by Google under its policies. Google is not responsible for the app, and any claim relating to it lies between you and us.

11. Governing law

These terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-law rules, and disputes will be handled by the state and federal courts located in Wyoming. Nothing here removes any right you have under the mandatory consumer-protection law of the country you live in.
